The Indian government should pay serious attention to the alleged evidence produced by the Channel4 TV documentary on Sri Lankan war crimes. ‘

Our attention has been drawn to a disturbing documentary titled Sri Lanka's Killing Fields produced by Jon Snow of the Channel4 TV channel of the United Kingdom.

The documentary highlights the results of a forensic investigation into the bloody culmination phase of the counter-insurgency operations of the Sri Lankan Security Forces against the Liberation Tigers of Tamil Eelam in April-May, 2009.

It alleges that the culmination phase, which physically wiped out the leadership of the LTTE for which no right-thinking person opposed to terrorism need shed tears, was also marked by executions, shelling of civilians and other atrocities carried out by the security forces.

The Sri Lanka Campaign focuses on campaigning, advocacy and related capacity building work. Unlike other human rights and pro-democracy organizations that cover many countries, we focus on just one - in a similar vein to the campaigning groups working on Burma, Sudan and Tibet.

We campaign for the end to the suffering of almost 80,000 plus civilians still currently held in the crowded and unsanitary main internment camps and closed transit camps. We also call for the fundamental human rights of more than 10,000 people who are detained on suspicion of having been involved with the LTTE.

With the ground situation so grim, we continue our advocacy work which has seen some successes. However, there are no real signs of a just political solution which can address the roots causes of Sri Lanka’s problems.

Since the end of the war, President Rajapaksa has gained two electoral powerful mandates. The first, for his role as President, was gained in part by state manipulation of the campaigning process. The second mandate was secured during the time the opposition candidate, the war hero General Fonseka, was in jail on charles of treason. President Rajapakse is tightening his grip on the country and pushing back prospects for healing and reconciliation. If the lack of attention and pressure from the international actors and the media is allowed to continue, we share the fear of many commentators that Sri Lanka – previously a democracy which has previously enjoyed strong economic growth and where multi-ethnic identity was a given - could become a latter day combination of Burma (nepotism), Tibet (ethnic neutralization) and Palestine (ethnic apartheid).

Communal Mindset of the Gujarat Government Leadership

Analysis of the Communal Mindset of chief minister Narendra Modi as revealed in his public utterances during and after the state sponsored carnage in 2002, especially through the speech he delivered to set of his electoral campaign on 9.9. 2002
The speech of the chief minister, Shri Narendra Modi has clearly not got ingredients of communal incitement is clearly baseless observation after even a prima facie reading of the speech. (Full text attached below). Despite CJP’s efforts to get directions from the Court that an FIR under sections of the ciminal law are registered, the Courts including the Supreme Court failed to order this.
Such speeches from a chief minister, duly elected, have the potential to adversely affect communal amity. Besides, in fact, there were several incidents after September 2002 in Gujarat despite hot denials by IAS officer Shri Murmu.
Barely had the violence been brought under control that an unrepentant state government caused the forcible closure of relief camps all over the state of Gujarat (1,68,000 persons were officially admitted to be living in such camps) . This illegal closure of the camps was conducted with the avowed objective projecting normalcy and hurriedly holding elections after sharp communal violence and polarization. The then CEC, James Lyndoh had taken strong objection to these moves by the state government and ordered many rectification measures and rejected the state government’s demand for holding early elections. The CEC Report of 16.08. 2002 mentions these facts. To push the state government’s claim, the then Central government had supported the state’s move and after a Presidential Reference approached the Supreme Court who had held the EC to be the final authority to fix the schedule of elections. Despite the pernicious impact of the content of the speech on both majority and minority communities, the chief minister, Shri Narendra Modi has continued to make speeches in a similar communal vein even in Mumbai and other locations.
In the four affidavits filed by ADGP Intelligence Shri Sreekumar before the Nanavati-Shah Commission contain the Four SIB Reports dated 24.04.2002, 15.6.2002, 20.08.2002 and thereafter 28.08.2002 clearly portray the connivance of the state government, the ruling party and fraternal organizations and the subsequent subversion of the Criminal Justice System against the Minority, a state of affairs that continues until today.
The Sequence of Events and Documents of the Gujarat State Intelligence Bureau annexed below
Sequence From Internal Documents:
A. A Fax Message Recd from National Commission of Minorities (NCM) to State Government addressed to the Chief Secretary, Gujarat asking for information regarding the Becharaji Speech of the Chief Minister. The communication dated sent by fax dated 10.09.2002 states, “It is learned that inflammatory speeches were made against the minority communities during the Gaurav Yatra as per the reports in various newspapers today. I am directed to request you to kindly send the full text of the said speeches reported in the newspapers dated 10.9.2002.”
B. The copy of the above was sent on the same date to ADGP Intelligence from the Home Department and the DGP, Gujarat for necessary action directing, “Please give report of above said speeches as reported in the newspapers gated 10.9.2002.”
C. Simultaneously, the State Control Room informed the ADGP, Shri RB Sreekumar telephonically of the fax message by the Chief Secretary. The ADGP verbally instructed Shri Prabhat Patel, Dy. Commissioner,
Addl. Director General of Police. (Int.) Gujarat State, Gandhinagar to do the needful.
D. Thereupon Shri Patel has sent the letter annexed hereto with other abovementioned documents (zerox copies) in translation dated 12.9.2002. The relevant paragraph regarding SIB’s(State Intelligence Bureau’s) assessment on the contents of the CM’s speech is the Para 13 reads “ On the whole the speeches of the CM during the Gaurav Yatra evoked good response. But, the thrust and style of the speeches made by the Chief Minister at Behucharaji at Mehsana district and Chanasma, Patan district had wounded the feelings of the minority community and because of that there was a possibility of worsening of prevailing communal situation in the state”.
E. Despite these adverse reports from the SIB, the then DGP Chakravarthi, on 12.9.2002 telephoned and instructed ADGP Sreekumar that Additional Chief Secretary Home Shri Ashok Narayan, did not want SIB to send the report on the speeches delivered by the Chief Minister at Becaharaji. The DGP Chakravarthi has subsequently given written instructions to this effect on this also that can be observed from the hard copy notations in his handwriting on the relevant documents produced by CJP in Court. These notations have been made on the top portion of the zerox copy of the NCM’s fax dated 10.09.2002.
F. Thereafter on 16.09.02 Shri Himanshu Bhatt has sentthe verbatim translation of the CM’s speech in Gujarati with the video copy to Additional Chief Secretary, Ashok Narayan with a copy to the then DGP of Gujarat, Shri Chakravarthi.
G. The entire sequence of events have been contemporaneously documented by an officer not less in rank than the ADGP, Gujarat, Shri RB Sreekumar in his Register that we annexe hereto Annexure G . The relevant entries to be note are entries 10, 11, 12 and 13. Register entry appended with the Third Affidavit before the Nanavati-Shah Commission of RBS (dtd 9.4.2002). To quote from the entry : “Thereupon, I talked to Shri Prabhat Patel, Dy.Commissioner of Intelligence (Communal) to move the concerned officers in Mehsana and get the audio or video cassettes containing this inflammatory speeches of the Chief Minister against Minorities.
10. 9. 2002.
Later, it is known from my personal sources that the Chief Minister, in his speech, as part of Rathyatra in Becharaji, a temple town / village in MEHSANA district has made many derogatory references to the Minorities (Muslims). The major condemnable part of the speech with derogatory references are (1) that his Govt. (Modi) Government has brought Narmada water to the dry river bed of Sabarmati in Shravan month, the holy month of Hindus, but the Congress Party is unhappy about it. The Chief Minister sarcastically communicated as to whether he should have brought Narmada river water in the month of RAMADAN (Holy month of Muslim), (2) that he is averse to running relief camps, which in his view has become ”children producing factories”. He further commended that certain people produce children in plenty and then children will work for repairing cycle viz. cycle puncture repairs, (3) that his Government is going to implement family planning programme vigorously. This will teach the lesson to people, who are keeping as their motto Han Paanch hamaare Pachis (Hum Panch hamare Pachis)(This refers to Muslims because a Muslim as per Shariat law can keep 4 (four) wives). The Hindu chauvinistic audience applauded such remarks. It is learnt that such crowds are specially commandeered to the meeting place by Sangh Parivar activities. The above impression was is conformity with the Newspaper report appeared in Newspapers.

A fax message from National Commission for Minorities with endorsement from State Control Room was received with the endorsement that “Please give above said speeches as reported in the Newspapers dated: 10/9/2002”.
This fax message also contained endorsements thus “issued and by order of Shri P.S.Shah Addl.Secretary (L/O).
12/09/2002
In the evening DGP Shri K.Chakravarti telephoned and instructed that the Addl.Chief Secretary (Home) now did not want CID (IB) to send report on speeches delivered by the Chief Minister at Becharaji (Mehsana district). DGP said that he would be sending written instruction in this matter.
“In the mean while Shri Prabhat Patel, DCI (C) informed that IB (State) officers are still trying for gathering the details of speech made by Shri Modi the CM and if possible the audio or video tapes also.
“13/09/2002
Shri Prabhat Patel informed that the audiotape containing the speech made by the CM at Becharaji (Mehsana district) containing anti– Muslims utterance was procured by SIB officers. I asked him to keep it in safe custody. I asked him to prepare a verbatim of the speech and report to ACS and DGP, as usual.
Shri Prabhat Patel told me that the same can be done by Shri Himanshu Bhatt, as it is his subject.
Thereafter, I asked Shri Himanshu Bhatt DCI (P) to send the verbatim report of the tape along with the tape to DGP and ACS. 15/09/2002
I was at home at 11.30 HRS DGP Shri Chakravarthi rang up (by phone) and in agitated mood told me that STAR NEWS election channel has been showing from this morning in the news that State IB had reported about the controversial speech of the CM at Becharaji and also added that we (SIB) had observed in the said report that the communally inciting reference made by the CM in the speech would adversely affect the prevailing fragile communal situation, widen the communal divide, between Hindus and Muslims, give fillip to the Islamic fundamentalist elements, etc. The Star news had also mentioned the letter No. and date of our report.
“DGP added that the Chief Secretary Shri G.Subba Rao, IAS, asked DGP to issue a denial statement. DGP inquired as towhether it could be done. I replied that no denial should be issued because State IB did dispatch such a report about the controversial speech made by the CM on 12/09/2002. I also told DGP that there are specific provisions in Police Manual directing all police officers to take a serious note of any speech or utterances having potentiality to incite communal passions, fuel hatred between segments of society, etc.
“DGP added that the CM, CS, etc. are highly annoyed about the leakage of the SIB report and tape. He asked as to who would be responsible for the same. I replied that I had taken all precautions in this connection and I did not contact any outsider in this matter, etc. I also added that I am not suspecting any of the staff or officers of my department in this lapse.
“I added that it was the onerous duty of the State IB as per the charter of SIB given in Police Manual (Rule 461, probably) to report on all development in the communal front and since the CM’s speech is in a very bad taste we had promptly reported the matter to the higher formations.
“DGP closed his talk telephonically by telling me that further action in this matter would be decided on 16/9/2002, Monday. ”
Regretful Conclusion
CJP pointed out to the Supreme Court that that these contemporaneous notings are relevant and crucial. Though there were persistent efforts by the State of Gujarat to conceal documents and obfuscate the grievous happenings of 2002. The speeches of the chief minister were nothing short of crude attempts to rub salt on the wounds of a battered minority and worse still garner votes through an appeal to religion. Both are offences in Constitutional and Criminal Law. affidavit of Shri G. Ganeshan, Under Secretary to the Government of India, Respondent 1, dated 30.8.2006. Stating that the Government of India is only a proforma party in this matter, , that Law and Order is a State Subject under the VIIth Schedule of the Constitution, Shri Ganesh refers to a series of Advisories sent by the Ministry of Home Affairs on the issue of hate speech and hate writing. The petitioners pray that these Advisories are placed on the records of this Hon’ble Court.
0. Unfortunately, despite several advisories issued on the issue of hate speech and writing by the Union Home Ministry the stand of the Central Government was ambivalent. While making a reference to several Circulars and Missives issued to the States on the sensitive subject of Hate Speech, these were not been placed on record. It would be useful for the purpose of this matter and in the public interest to have these on the record of the present case.
Moot Point
Finally the crux of the matter is simple. Can such speeches after being challenged by citizens in a Court escape the scrutiny of the apex court? The CM of any state occupies a Constitutional post, and once elected represents the entire citizenry, not a section of the people based on religion or caste. If such a political and electoral approach and mindset as revealed in this speech are allowed uncontested and non-censured by the Court and not dealt with by Judicial Scrutiny, this will weaken the faith of the ordinary Indian in our Constitutional Mandate. Strict words and punitive action for the high and powerful if they breach the delicate balance between free speech and elementary decency need to be affirmed.
Verbatim of Public Speech delivered by the Chief Minister, Shri Narendra Modi, at Bahucharaji (Mehsana district of Gujarat State) on 9.9.2002, as part of Gaurav Yatra.
The procession of prestige (Gaurav Yatra) has now reached the holy land of Bahucharaji, from Fagwel, by blowing the bugle of self-respect of Gujarat. This is the holy place of power (Shakti), the power for extermination of Ashuras. We have resolved to destroy and stamp out all forces of evil, who are a threat to the self respect of Gujarat. A set of people, who are not concerned about ordinary Gujarati citizens, are keen to impede progress of Gujarat State and its future, are out to defame Gujarat State. In this holy land of Bahucharaji, let the 5 Crores Gujaratis acquire such power and energy, which will build tomorrow’s prosperous Gujarat. There is allegation against us that we are Hinduwadis. Oh! brothers, for the development of Bahucharaji Devi temple, our Govt. has allotted 8 Crore Rupees. Is it a crime done by us? Have we become communal by allotting 8 Crore Rupees for the development of Bahucharaji. Our Congress friends have come out with another charge. They say, this Narendrabhai has brought Narmada water to Sabarmati river and this man is so much clever that he brought the water in the month of Shravan (a holy month for Hindus). My dear brothers, we built the dam and so water is available. Let me ask a question to my Congress friends, if water is brought during Shravan month, those mothers / ladies residing on the banks of Sabarmati river can take bath in Narnada water and feel holiness and blessedness. Then what is paining them? Since, we (means BJP) are here, we brought water in Sabarmati during the month of Shravan, when you are there, you can bring it in the month of Ramdan (the holy month of Muslims). When, we brought water in the month of Shravan, you feel bad. When we spend money for the development of Bahucharaji also, you feel bad. What brother, should we run relief camps? (referring to relief camps for riot affected Muslims). Should I start children producing centers there, i.e relief camps? We want to achieve progress by pursuing the policy of family planning with determination. We are 5 and our 25 !!! (Ame panch, Amara panch, referring the Muslim polygamy). On whose name such a development is pursued? Cant Gujarat implement family planning? Whose inhibitions are coming in our way? Which religious sect is coming in the way? Why money is not reaching to the poor? If some people go on producing children, the children will do cycle puncture repair only?
If we want to develop Gujarat, every child born in Gujarat should get education, enlightenment, livelihood and the economic order should be built up accordingly. For this purpose, there is a need for teaching a lesson to those people, who are expanding their population (Hinting at Muslims). If we object to the explosion of population, they feel bad. Can somebody tell me, is there any Nation like ours? Is China ruled by BJP? Still China had enacted a law to curb population explosion. Here some people say no no, Are we religious fundamentalists. Brothers, in this matter, how religion is involved? In Gujarat, Madrasas are coming up in large numbers. The children have right to get primary education. But, Madrassa going child is deprived of primary education. What will such a child do, when he grows up? Suppose, normal education is not available and only religious education is available, will it not be a burden on Gujarat. We are scrutinizing Madrassas from Kachchh (district) onwards. Now these people may say that we are communalists. If West Bengal Govt. put restrictions on Madrassas, it is secular, but when it is done in Gujarat, how do we become communal? Any institution needs regulation. If we want peace in Gujarat, we have to make long term plans. We cannot permit merchants of murder freely operate in Gujarat. I am sitting in the holy place of Shakti (energy), in the lotus feet of Bahucharaji Mata. I want to assure you that I may lose the chair tomorrow or today. But, I will not allow those plotting to destroy Gujarat and harm the innocent, to carry out their plans. Gujarat wants happiness, Gujarat wants peace, 5 Crores Gujaratis are united and progressing. The days of somebody like Daud Ibrahim sitting in Karanchi and playing games of murder and destruction are over. We would not permit it. For what purpose all this is done. My chair may go today or tomorrow. We are not sticking to the chair with fevikol. Brothers, we are sitting at the feet of the Gujaratis. If the people feel that this person (referring to himself) will work, then they will put him as their head. And if the people don’t feel, then they will kick us out. Brothers, we are a set of people, who are always at your service. The Congress is afraid of going to the people; they do not want the election. Oh brothers, if you do not want the election because you are going to be defeated and so you want to delay the holding of election? Smt. Indira Gandhi was afraid of going to the election. Therefore, she extended the tenure of the Parliament to 6 years. Why don’t you do the same thing? But you are afraid of doing that. What do you talk? There are disturbances in Gujarat. The people of Gujarat indulge in riots. If you don’t want face election you have no right to abuse 5 Crores Gujaratis. This is not acceptable to us. If you have courage, brothers, why don’t you bare your chests and face us in the battle field of election? Why do you run away? If one has to run away, we have to do it. There is propaganda is against me through out the World. It is done by you (Congress men). We are willing to go to the people and you are running away from the people. Why don’t you go to Italy?, Go, and offer aarti (offering by holy flame) to the Election Commission. You are shouting, stop elections, stop elections, Oh mother ! stop elections, Oh Congress friends ! We have taken the dust from the feet of 5 Crores Gujarati on our head. We are one with them and we are proud of telling that. We are not cheats. If you go to collect the dust from the feet of the people of Gujarat they will kick you. We have no selfishness. This daughter of Italy (Sonia Gandhi) had given us open certificate that we had insulted the land of Mahatma Gandhi and Sardar Patel. We have to demand your answer in this matter. How much did you insult Sardar Patel? The Nehru dynasty of Congress people, develop fever hearing the name of Sardar Patel. You may feel sad, Sanjay Gandhi was no great man other than being the husband of Menka Gandhi. But, there is samadhi of Sanjay Gandhi at Rajgadh. Oh my Brothers and Sisters of Gujarat ! Sardar Patel does not have a samadhi (in Delhi). We feel very sad about it. You Congress people, you are toiling for effacing out the name and image of Sardar Patel, but I warn you, Beware, if you try to wipe out the fame and name of Sardar, we are here to sacrifice our lives for keeping the flag of Sardar at high pedestal. We believe that, if we have to do good of the Nation, we have to adopt the path of Sardar Patel. If you want to save Kashmir, you have to walk in the path of Sardar Patel. If you want to bring unity in Gujarat, you have to adopt the path of Sardar Patel. If you want to contain and check the merchants of murder, we have to follow the path of Sardar Patel. Our motto is to pursue the path of Sardar. There are people, bent upon destroying Gujarat. We have come out for awakening the self-respect of Gujarat. If we raise the self-respect and morale of 5 Crores Gujratis, the schemes of Alis, Malis and Jamalis (referring to Muslims) will not be successful to do any harm to us. These 5 Crores Gujaratis will decide about their future. The buffoons of Delhi will not decide the future of Gujarat. In Delhi, there is a crowd of Ex. Prime Ministers, who are sitting idle. In the evening, these Ex.Prime Ministers meet. They issued Fatva (royal proclamation) that in Gujarat the Rathyatra of Jagannathji should not be taken out. We asserted that it will be taken out. In Gujarat, if the Rathyatra of Jagannathji is not taken out, whose Rathyatra should come out ? People sitting in Culcutta (referring to the communists), do not want the Rathyatra to come out. It will be better to go out of the Govt. instead of not taking out Jagannath Rathyatra. I don’t care if I loose political power and authority. We have decided that Jagannath Rathyatra will be taken out. Then, the whole crowd of Congress people rushed to Delhi, to Madam (Sonia Gandhi), appealing, Madam save us, this Narendra Modi is a mad man, and we cannot compete with him. Save us, solve the problem of Narendra Modi. Madam said, what happened? Stop Jagannath Rathyatra, if the Rathyatra of Jagannathji is taken out Gujarat will burn. Muslims will be massacred, there will be wide spread hue and cry, stop the Rathyatra of Jagannathji, stop the Rathyatra of Jagannathji, stop the Rathyatra of Jagannathji. When Congress men told this thing to Madam, finally she asked, brothers, tell me this Jagannathji is belonging to which political party? Is this Jagannath Rathyatra like Advani’s Rathyatra ? (The Congress men replied) Oh Madam, this Jagannath is not worker of any Party. Jagannath is God (Bhagwan). Does Bhagwan Jagannath belong to any Party? See, such (ignorant) people are set our for serving the Nation !!! Mahatma Gandhi used to say “Drive away these white men”, “Oh white men, quit our Country”. But, what did Congress do? Oh white people, please come, be our Congress President, Oh white people, please come, be our Congress President. Congress is like a Dharmashala. They (Congress men) are set out for destroying Gujarat. Therefore, there is a need for awakening the self-respect of Gujarat. In this holy place of Mother Goddess, let us pray God, to bestow us fresh energy, let there be new ideas. By serving the Mother India, let us make Gujarat also proud. We should enhance and brighten the image and identity of Gujarat. Hail Mother India, Hail Mother India (Bharat Mata Ki Jay), Vande Matram, Vande Matram, Vande Matram (Salutation to the Mother).
CONCLUDING COMMENTS
As can be deduced from perusing the above there is a clear cut design behind the deliverance of such a speech by the chief minister, who swears an oath of allegiance to the Indian Constitution. For example:
--- We have resolved to destroy and stamp out all forces of evil, who are a threat to the self respect of Gujarat. (Comment- This is clearly an indirect justification of a policy of carnage against the minorities after the tragic Godhra incident).
---- Let me ask a question to my Congress friends, if water is brought during Shravan month, those mothers / ladies residing on the banks of Sabarmati river can take bath in Narnada water and feel holiness and blessedness. Then what is paining them? Since, we (means BJP) are here, we brought water in Sabarmati during the month of Shravan, when you are there, you can bring it in the month of Ramdan (the holy month of Muslims). ( Comment- The Holy Month of Ramzan and observance of Roza are one of the Five Pillars of Islam hallowed in the Holy Koran. The mens rea (motive) behind making this reference in the speech can be clearly deduced.
---- What brother, should we run relief camps? (referring to relief camps for riot affected Muslims). Should I start children producing centers there, i.e relief camps ? We want to achieve progress by pursuing the policy of family planning with determination. We are 5 and ours are 25 !!! (Ame panch, Amara panch, referring the Muslim producing five children) .
(Comment- These remarks from the highest elected representative in a state is nothing short of an attempt to ridicule the plight refugees from the minority community who were dishoused because of widespread violence that was not contained. Refugees in relief camps included victims of mass massacre, rape and arson. State complicity at the highest level has been judicially held responsible for the sustained spread of the violence. Therefore ridiculing the camps and thereafter lacing the statement with the poisoned stereotype of the alleged Muslim aversion to family planning during an election campaign clearly has a motive. This statement also projects the Muslim minority as a stumbling block to progress and patronises an ‘us versus them’ mindset among the populace that then becomes easy fodder for incitement and the outbreak of communal violence. )
On the whole the speech displays a definite communal bias, denigration of the minority community, ridiculing and belittling of the Holiest Scriptures of the minority community particularly the Five Pillars of Islam, the Holy Month of Ramzan and Observance of Roza. I say and submit that these references will certainly germinate a sense of hatred ill will and excluvism towards the Muslim minority in the minds of the majority community. The claim that nothing happened in the form of riots after the speech is irrelevant, dangerous and untenable because the sense of excluvism and sectarianism obvious in the tone and tenor of the speech not only goes against he concept of emotional integration of the Indian people but also engenders an intense feeling of alienation among the Muslims towards the Hindu community. In this perspective the speech of the chief minister is injurious to the Preamble of the Indian Constitution and Particularly Article 51-A that is the Chapter on Fundamental Duties.

(a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;
(b) to cherish and follow the noble ideals which inspired our national struggle for freedom;

(e) to promote harmony and the spirit of common brotherhood amongst all the people of India transcending religious, linguistic and regional or sectional diversities, to renounce practices derogatory to the dignity of women;
(f) to value and preserve the rich heritage of our composite culture;
(g) to protect and improve the natural environment including forests, lakes, rivers and wild life, and to have compassion for living creatures;
(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;
(i) to safeguard public property and to adjure violence

Teesta Setalvad Secretary Citizens for Justice and Peace submitted this searing evidence before Dr RK Raghavan’s SIT as far back as December 15 2009. When SIT appeared to do little with the evidence it was filed as evidence before the Nanavati-Mehta-Shah Commission on 14.5.2011 and finally before the Supreme Court on 10.8.2010

(in which Setalvad as Secretary CJP is the second petitioner in SLP 1088/2008 Smt Zakia Ahsan Jafri and CJP v/s State of Gujarat)

It is Public Evidence that should be read by All

As you are aware following our application in the Gulberg Massacre trial currently afoot in Ahmedabad, we have been ourselves scrutinising, as co-complainants the records and locations of five lakh phone call records contained in th CD submitted by Shi Rahul Sharma before the Nanavati Shah Commission in 2004. Cetain extremely disturbing facts have come to our attention pertaining to the individual trials afoot and also relating to the extremely sensnitive investigation into the complaint of criminal conspiracy to commit mass murder against the chief minister Shri Narendra Modi and 61 others currebtly being conducted by yourselves. Our peliminary inquiries that have managed to identify some thirty five per cent of the call identities and locations after sources phone call directories officially since 1999 reveal

a) that PI Meganinagar was in touch with key and influential accused of the Naroda Patia and Naroda Gaon trials (suggesting a wide ranging conspiracy that simply the failure or complicity in individual incidents of mass violence in the city of Ahmedabad and state of Gujarat between February 28, 2002 and February March 5-6 2002;

b) DCP Gondia of Zone IV that covers both the Meganinagar and Naoda areas ws in touch with the same key accused (Maya Kodnani, Jaideep Patel and Nimesh Patel who were in touch with KG Erda; as serious or notable are the facts that he was also in touch with senior officers of Central IB and also the Secretary (Home) Gujarat state Shri Nityanandam;

c) that the movements and locations of Joint Commissioner Shri MK Tandon become relevant given eye witness tetsimonies on the destruction of bodies after being killed following the evening of 28.2.2002;

d) that the movements and locations of Additional Commisioner Shivannad Jha and Commissioner PC pane also become relevant for a wide range of supporting and uestinable evidence;

e) that the movements and locations of key political functionaries especially Shri Ashok Bhat then minister health and IK Jadeja then minister urban development are also similarly relevant;

f)that the movements of the IAS/IPS officers forming the key coterie around the chief minister are relevant for the same set of reasons;

g) that functionaries, party and government like Rajendra Singh Rana (who called the bandh supporting the bandh call by the VHP and BD on behalf of the Bharatiya Janata Party);


h) that the call records and locationald details of functionaries of the VHP/BD like Haresh Bhatt, Dinesh Togadia, Anil Patel, Ramesh Dave, Atul Vaid etc also become relevant for the abovementioned reasons.

i) It is also pertinent to note that critical records of Police Control Room and other documentary evidence have been destroyed while the Supreme Court heard the case. Surely this amounts to subversion of the process of justice ?


ANALYTICAL NOTE

1. Political environment prior to Godhra train burning incident

– BJP had not fared well in the local elections and the by-elections to the Vidhan Sabha in second half of 2001;

– Keshubhai Patel was replaced by Narendra Modi in September, 2001

Rajendra Singh has been alleged to, by Shri RB Sreekumar former DGP Gujarat state to have at the behest of the BJP central and state leadership (specifically former home minister and deputy prime minister LK Advani and chief minister Narendra Modi) to have “floated” the idea of an ISI conspiracy behind Godhra without any ground level data or proof


4. Pointers to suggest involvement of highest political functionary
• Postmortem done hastily at Godhra Railway Yard itself
– Allegedly on the instructions of the CM (phone call records between Personal Secretary to the CM and the Health Minister)
– Bodies could reach Ahmedabad by next morning for the proposed funeral procession
– To inflame the anger of the funeralists, which could be converted into a violent communal reprisal.
• Bodies handed over to Jaideep Patel, Vice-President, VHP, (not to an official functionary) for carrying them to Ahmedabad.

– Allegedly on the instructions of the CM (affidavit of ACS, Home and Collector, Godhra filed before the Nanavati-Shah Commission)

• Dead bodies carried by road to Civil Hospital, Sola, Ahmedabad in open trucks against advise by officers.
• Call for Gujarat Bandh by the VHP.
• State’s endorsement of the bandh through Press Note.
• The CM called a meeting of senior police officers & bureaucrats on the night of 27th February, 2002
– Officers were “advised” not to take action against the riotous mobs the next day and let people vent their anger.

• Positioning of senior ministers/party functionaries at selected Police Control Rooms on 28th February, 2002
– to monitor riots
– to ensure police inaction
• Muslim residential colonies, shops & establishments identified beforehand.

It may be appreciated that in such of cases, direct evidence may or may not emerge against the main conspirators as they often function behind the scenes and are often not present on the spot. The investigation, therefore, needs to be conducted in a manner to bring out inferential evidence pointing towards the conspiratorial role of the main accused. A thorough scrutiny of the documentary evidence becomes vital.

An illustrative example of how the investigation requires to be conducted to prove the case against the main conspirator is detailed below. Proper and meticulous investigation if carried out against the middle level officers will prove the conspiratorial role of the chief political functionary. Unfortunately, so far, nothing has been done by the SIT the lines suggested herein below.

5. Members of CM s close coterie at Meghaninagar area between about 2 p.m. and 6 p.m. on 27.2.2002 when chief minister was in Godhra. This area was the not the typically communally sensitive area of Ahmdabad and the scene of possibly pre meditated massacres the next day. (Details of call locations below)




1. Combined Analysis of Phone Call Records of Three Senior Most Officers in Ahmedabad City

Analysis of the mobile phone records of the three officers is being done here. The three officers and their mobile numbers are given below:

i) Mr. P.C. Pande, the then Commissioner of Police, Ahmedabad City (Mobile Phone Number: 9825048303: Celforce Network)
ii) Mr. M.K. Tandon, the then Joint Commissioner of Police, Ahmedabad City (Mobile Phone Number: 9825048316: Celforce Network)
iii) Mr. Shivanand Jha, the then Additional Commissioner of Police, Ahmedabad City (Mobile Phone Number: 9825048308: Celforce Network)
iv) Mr KG Erda then PI Meghaninagar, now DYSP ad made an accused by SIT in the Gulberg case (as late as May 2009), receives several calls from Maya Kodnani, Jaideep Patel and Nimesh Patel all accused in the Naroda Gaon and Patia cases;
v) PB Gondia DCP Zone Iv receives over a dozen calls from the same set of accused as also from Central IB man Rajendra Singh and Sec Home, Nityanandan three or four times.
vi) PI Naroda KK Mysoewala who has only been promoted since 2002 (and has not been arraigned by SIT despite four witness statements against him pointing out to his active connivance with the rioters) has only a single call recorded on his official mobile and that one conversation he has is with Jaideep Patel, VHP state secretary and accused in the Patia and Gaon cases.

All the three senior officers have their offices in the same building (Pande, Tandon and Shivanand Jha) – the office of the Commissioner of Police, Ahmedabad City.

Analysis of the phone records of the three numbers would show that the officers moved in the morning of 28.02.2002 in the following manner:

i) Mr. P.C. Pande:
He was in his office till about 1:00 am on the night of 27.2.2002 that is the early morning of 28.2.2002. In normal times, he used to leave office at around 7 pm every evening. It was an apprehension and of trouble and a seasoned assessment that after the Godhra incident, some trouble may break out that on 28.02.2002 that made him stay so late. This clearly suggests that he was aware of the gravity of the situation following the Godhra carnage on 27.02.2002.

He arrived at his office in the morning at around 8:00 am. His normal schedule shows that he used to arrive at his office at about 10:30 am. His early arrival again shows that he was aware of the gravity of the situation.

Mr. Pande left his office at around 9:45 am and went towards Gota. This is likely to be his visit to to the Sola Civil Hospital, where the dead bodies of the Godhra Victims had been kept. He returned and reached office at around 10:50 am. He was confined to his office for the whole of the day and did not move out till about 19:10 hrs., when he probably went to Gulberg Society, Meghaninagar.

The important point to be noted is that during the peak period of the communal riots, he did not move out of his office. (It also appears that he did not issue any instructions to any of his officers and let things take their own course. However, this aspect would be discussed later.)

The phone call records of the chief of police, PC Pande’s need to be collated with wireless communications, control book records, message books and phone records. This has been studiously avoided by the SIT.

PC Pande’s Phone records need especially to be collated closely with the records of both the Police Inspector in Charge of Meghaninagar police station (Gulberg massacre), KG Erda and that of Police Inspector of Naroda police station area (Naroda Patia and Naroda Gam), KK Mysorewala.

An analysis of the call details of PI KK Mysorewala (09825190775) (now promoted) show that on 27.2.2002 there is only one call received by him from his official number. The number calling was 09825047044. On 28.2.2002, his phone records show that he (Mysorewala, a policeman) was in touch with VHP accused, Jaideep Patel, accused in the Naroda Gam and Patia cases. He received a call from Jaideep Patel (09825023887) at 10:55:20 for 28 seconds. He was shown in Narol, Naroda at the time and this was when the massacre was at its height.

Analysis of the Calls Made and Received by KG ERDA IO Meghaninagar (now accused by SIT in its charge sheet dated May 16, 2009) are also significant.

K G Erda’s phone call records show that he had been in constant touch with the Control Room through 27.2.2002 and 28.2.2002. In fact even the day of the Godhra Train Burning tragedy PI Erda had been in touch with the Control Room from 1.21 p.m. to 11.10 p.m., even being in touch with his immediate superior Gondia.

On 28.2.2002, of the 28 logged calls made and received by him,, 13 were made by him to the police; 10 calls logged on his mobile show that he called the Control Room 10 times speaking for a total of 688 seconds that is about 12 minutes; three Calls were made by him to the local, Meghaningar Police Station during which he spoke a total of 65 seconds that is a little over a minute; 2 calls were made to DCP Gondia and 2 calls to Joint Commissioner of Police, MK Tandon.

The fact that this police officer, the man on the spot, the PI was in touch with the Control Room except between 15:33 p.m. and 17:52 p.m. (that is for a period of two hours and twenty minutes) when he preferred to call his immediate bosses DCP Gondia and Joint CP MK Tandon could also lead to some revelations. This is because this was a critical period of the killing and carnage at the Gulberg Society when frantic messages to the Control Room could have yielded more immediate help and results.

In Police and Law Enforcement language, a call to the Control Room means a call to the Commissioner of Police, Ahmedabad in this case. Various Officers in charge of the Control Room are expected, area wise to report to the CP every 15 minutes. A close scrutiny of the Phone Call login records of the various Police Stations connected with these trials, the Police Control Room, Shahibaug Ahmedabad, and State Control Room, Gandhinagar would reveal which officers had performed their duties and informed their superiors. If these records then show that after having received such critical information from a close coterie of senior officers who were in touch with the CMO did not act, then allegations of conspiracy get substantiated. It was expected that SIT would ruthlessly investigate these records to arrive at a watertight conclusion, one way or another. SIT’s failure to do and to submit charge sheets in the critical Gulberg Massacre case without any of these investigations being attempted leave alone completed, suggests a desire to cover up what all along the Gujarat Police and State of Gujarat have been trying to do.

To top it all, the phone call records of PI Meghaninagar KG Erda also reveal that on 28.2.2002 he was in touch with influential and key accused at various times of the day. At 15:20:35: Erda (98250116221) receives a call from 792682186 (then MLA Maya Kodnani's Office No.), a call lasting 19 seconds. It is submitted that Kodnani was Minister Women and Child Development in 2009 when she was given notice of arrest by SIT. She then absconded for several days before surrendering to be arrested. Smt Kodnani thereafter resigned her position and was refused bail by the Gujarat high court. At 18:20:31: Erda (98250116221) again called 09825006729 (Maya Kodnani’s mobile) and speaks for 93 seconds again from the Meghaninagar area. Mysteriously PI Erda, at 17:59:24 on 28.2.2002, (98250116221) also called 09824255788 a mobile number of accused Nimesh Patel, who is accused of killing 8 people in Naroda village. The call lasted 24 seconds. In what could be the strangest co-incidence or have the ingredients of a sinister conspiracy, the accused Nimesh Patel spoke from his mobile number (098242255788) four times on 28.2.2002, at 12:40, (for 29 seconds) at 10:03( for 32 seconds) at 20:58 (22 seconds) and at 12:21 (154 seconds) to accused MLA and Minister Maya Kodnani on 28.2.2002 as well.

ii) Mr. M.K. Tandon:
He, too, was in his office late in the night till about 1:15 am on 28.02.2002. In normal times, he also used to leave office at around 7:00 pm. Further, he arrived at his office at about 8:30 am on the morning of 28.02.2002. As in the case of Mr. P.C. Pande, his being in his office till late hours and arriving early suggests that he, too, was aware of the gravity of the situation.

Analysis of the cell phone data shows that Mr. M.K. Tandon was confined to his office till about 11:25 am after which he probably visited the Gulberg Society.
A detailed analysis of Mr. Tandon would be done later.

iii) Mr. Shivanand Jha:

He, too, was in his office late in the night till about 1:15 am on 28.02.2002. Normally, he used to leave office at around 7:00 pm. Further, he arrived at his office at about 5:10 am on the morning of 28.02.2002. As in the case of Mr. P.C. Pande, his being in his office till late hours and arriving very early suggests that he, too, was aware of the gravity of the situation.




Comments:
It is seen that both the sector heads – Mr. M.K. Tandon and Mr. Shivanand Jha did not move out of their offices till about 11:00 am despite mounting tensions and reports of gathering mobs and skirmishes. Even Mr. P.C. Pande, who had gone to Sola Civil Hospital, does not appear to have been involved in the control of riots. He probably was more concerned with his visit to the dead bodies at Sola Civil Hospital. As has been discussed earlier, all the three officers did not take early action to nip the riots in the bud, as has been provided for in the Gujarat Police Manual.

If this is true, then the acts of omission on the part of Mr. P.C. Pande and Jha could be part of a larger conspiracy to allow the mobs to kill and plunder. Consequently, he would stand as an accused in all the major riot cases being investigated by the SIT, namely, the massacres at Gulberg Society, Naroda Patiya and Naroda Gam.

Suggested Course of action:

Mr. Shivanand Jha first needs to be questioned on this. If he denies, he may be put through the polygraph test. This polygraph test may be conducted by a neutral team taking political considerations into account. An order of the Supreme Court for constituting this team may be required to remove any element of political bias. The entire polygraph test may be videographed.

1.1. Analysis of the Record of Mr. M.K. Tandon

As had been mentioned earlier, Mr. Tandon had visited Gulb3rg society at around 11:25 am on the morning of 28.02.2002. MK Tandon’s phone calls records show that he was received many calls from the political bigwigs and some accused. At 00:00:32 on 28.2.2002 he received a call from Govardhan Zadaphiya, MOS Home and later in the day around 5 pm. a call from Kaushik Jamnadas Patel , state minister for power. Nimesh Patel, accused of killing eight people was also in touch with him at 22:28:34 on 28.2.2009.

At 12:06:57 pm (afternoon), Mr. Tandon received a phone call from Mr. P.C. Pande. Mr. Tandon was at Gulberg Society at that time. They talked for about 75 seconds. What they talked about is not known?

At around 12:10 pm, there is wireless message from the vehicle of Meghaninagar Police Station to the Police Control Room informing that police had resorted to firing at Gulberg Society. Now, someone familiar with police operations would agree that it is not that police fires and rushes to inform the Police Control Room. Police would fire and then would inform the Control Room only when the situation eases a bit. This means that when Mr. Tandon got a call from Mr. Pande, police had either already resorted to firing or the mob surrounding the Gulberg Society had become so restive that police firing was imminent. In such a situation, Mr. Tandon would certainly have mentioned to Mr. Pande the grave environment prevailing at the Gulberg Society.

After talking to Mr. Pande, Mr. Tandon heads for Naroda Patiya. If this movement was on the instructions of Mr. Pande, it shows that Mr. Pande, who has reportedly pleaded ignorance of the incidents at Gulberg Society and Naroda Patiya before the Commission of Inquiry, was actually fully aware of the entire happenings. And that he lied before the Commission (may be also before the SIT).

Mr. Tandon reaches Naroda Patiya at around 12:15 pm, imposes curfew at 12:29 pm in Naroda Patiya (wireless message is available), and then leaves Naroda Patiya at about 12:33 pm – within 4 minutes of imposing the curfew! At this point a huge mob had already gathered at Naroda Patiya and its intentions to kill and plunder were apparent. It was for this reason that Mr. Tandon had to order the imposition of the curfew. However, Mr. Tandon made no effort to implement the curfew. He left the place leaving the hapless residents of Naroda Patiya undefended.

After leaving Naroda Patiya, Mr. Tandon goes to Dariapur & Revdi Bazaar areas where nothing is happening and all is quiet. Thus, Mr. Tandon is neither at Gulberg Society nor at Naroda Patiya despite having full knowledge of the prevailing situation at the two places. He is not present at the place where the crime is taking place despite having sufficient police force at his disposal. He, thus, intentionally abdicates his responsibility and abets the commission of the crime by the riotous mob.

Was this omission on the part of Mr. Tandon a mere act of cowardice or was it an intentional omission to leave the mob to kill, rape and loot? Given that he had earlier been instructed by Mr. P.C. Pande to “let things happen”, it is most likely that he fell in line and allowed the pre-planned pogrom to be executed without any obstruction or resistance.


Investigating the Chain of Command
DCP Zone IV PB Gondia is in touch with key accused, Mayabehn Kodnani, Jaideep Patel and Nimesh Patel seven times through the day.

Details:
The DCP Zone IV, PB Gondia (9825049197) receives a call from accused Jaideep Patel at 11:40:02, the again at 11:52:29 also from Jaideep Patel. Again Jaideep Patel and Gondia are in touch at 12:20:44.
At 13:53:59 another accuse d Nimesh Patel is in touch with this senior officer and then again at 14:13:47.
At 17:05:33 P B Gondia (9825049197) received a call from 792686136, the office landline of Maya Kodnani then MLA and now accused in both the Naroda Gaam and Patia cases.
In the morning of 28.2.2002 at 10:30:11, Gondia receives a call from Maya Kodnani’s mobile (09825006729)
At 18:55:59 and then again at 21:43:23 P B Gondia (9825049197) received a call from Nimesh Patel (9824255788). It appears as if this officer was regularly reporting to these two as at 22:10:52 P B Gondia (9825049197) made a call to 09824255788 (Nimesh Patel) and then at 11:40:02 he (09825049197) received a call from Jaideep Patel (9825023887)

LOCATIONS OF POWERFUL PERSONS AND ACCUSED AT NARODA
NAROL, NARODA
27.2.2002
At 05:10:53 Ashok Bhatt, cabinet minister for health accusede of sitting in the city control room and preventing policemen from doing their duty was at Naroda-Narol At 09:55:24 on 28.2.2002 around the time the massacre began, Ashok Bhatt was at Narol, Naroda. He received three calls there. Another key person from the coterie of the chief minister was at this location, Tanmay Mehta, PA to the Chief Minister who was there at Naroda at 16:02:OP Singh, PA to the chief minister was also there at 16:02:25 and they were in touch with each other. Ashok Narayan Additional Home secretary also accused in the Zakia Jafri Complaint was also present here at 5:41:32 (Narol, Naroda) as was IK Jadeja, minister at 17:35:25



Analysis of Location of Key Persons at Meghaninagar
MEGHANINAGR
27.2.2002
Close members of the chief minister’s cabinet and coteries were at Meghaninagar on 27.2.2002. At 15:48:39 Ashok Bhatt (919825039877), minister for health was here and around the same time Anik Mukhim, Additional Principal Secretary to the chief minister was also here.(15:33: 40). Mukhim was also here at 16:02:02 and then again that night at 22:01:18 . Others present there at Meghaninagar which is the jurisdiction area where the Gulberg society is located the day the chief minister was in Godhra was OP Singh, PA to the chief minister at15:48:16. PK Mishra, Personal Secretary to the chief minister is also present at Meghaninagar at 15:48:11 on 27.2.2002 and so also is Tanmay Mehta, PA to the chief minister (at 15:35:01)
Interestingly among policemen who are in the same area on 27.2.2002 are PB Gondia DCP Zone IV who is there are 00:36:26 that is on the early morning of that day.


28.2.2002

On the day of the massacres at Gulberg society and Naroda Patia and Gam, IK Jadeja, cabinet minister for urban development was at the Meghaninagar area at 15:56:40. MOS Home, Zadfaphiya was there at 17:02:38

1.1.1. Suggested Course of Action:
The above suspicion would require a sustained, even custodial, interrogation of Mr. Tandon.

(Information has also been received that heavy firing shown to have been done by the police during the riots was all bogus. In reality, police had “adjusted” the fired bullets by firing in dug-up pits on the bank of the Sabarmati river. In actuality very few bullets were actually fired on the mob.)

1.2. Analysis of phone records of Mr. P.C. Pande

The suspected role of Mr. P.C. Pande in the communal riots has already been commented upon. The following would only confirm what has been said earlier.

Analysis of the phone records of Mr. P.C. Pande on 28.02.2002 shows that he had received/dialled a total of 302 calls on his mobile phone. He had dialled 39 numbers from his mobile phone. Out of these 39 calls, he had called up the DGP, Mr. K. Chakravarthy, 6 times. He had dialled Mr. Shivanand Jha 8 times and his DCPs 8 times. He had called DCP, Zone IV, Mr. P.B. Gondia only twice (meaningful conversations) at 15:16:12 hrs. and 15:54:39 hrs.

Analysis of calls made from his land line in office to mobiles of officers show that he connected to mobiles operating in Ahmedabad City only 13 times. Out of these 13, 12 were incoming calls on his landline phone. He made just one phone call from his landline number and that too was probably not to an officer. In addition, this single call was made at 20:10:56, when most of the action had already taken place. It can be concluded that he did not use the landline to pass orders or instructions to his field officers.

As has been reported in the newspapers, Mr. Pande had claimed that he had no information of the happenings in Naroda Patiya or Gulberg Society. This is virtually impossible in field situations. Further, his knowledge of the two incidents gets support from call details, as has been explained above.

It must also be that since Mr. Pande was not informed of the incidents, he would not have sent any message to the officers in the field.

Thus, it can be concluded that there was virtually no instruction from Mr. Pande to take action against the violent mobs at different places. If we take into consideration the “admissions” made by Mr. Shivanand Jha to fellow officers, it raises strong suspicions that he (Mr. Pande) acquiesced in the crime.

The statement of Mr. Pande before a prominent television channel only speaks his mind and his deep involvement in the conspiracy. He had said, during the riots, “Where the whole society has opted for a certain colour in a particular issue, it’s very difficult to expect the policemen to be totally isolated and unaffected.”

Was Mr. Pande speaking of his own state of mind when he said this? Did he also want this (the communal pogrom) to happen?

As had appeared in the newspapers, the SIT had concluded that Mr. Pande was busy handling the dead bodies of the victims of Godhra Carnage. There are two aspects of this. Firstly, cell phone records show that he was sitting in his office all day long. He hardly seems to have done anything with respect to the dead bodies except paying a visit in the morning to the Sola Civil Hospital.

Secondly, is it a priority for a police officer to “handle” the dead bodies when the whole city is burning? Should he omit his basic duty to protect human life and property and, instead, go about “handling” the dead bodies? If he was so sensitive about the dead bodies, why did he allow the bodies to be brought all the way from Godhra by road through the streets of Ahmedabad? Did he also want the passions to flare up? The whole story of Mr. Pande attending to the dead bodies of the Godhra train carnage victims seems to be maliciously cooked up. It is felt that he has just thrown up an alibi and expects everyone to accept it.

The inaction on the part of Mr. Pande is very apparent. The question that arises is regarding the cause of this inaction. Did he omit to take necessary measures out of his own volition? Or was he coerced into doing this? The first option is less likely because Mr. Pande had nothing to gain from this. The second option is more likely. If this were so, who could have “pushed” Mr. Pande into such gory acts of omission? It could only have been someone who was significantly more powerful than him. The needle of suspicion points towards the political leadership, which had everything to gain in view of the impending elections and the poor electoral fortunes of the BJP.

There is another viewpoint in this. On the evening/night of 27.02.2002, a meeting was held under the chairmanship of the CM, Mr. Narendra Modi. Mr. Pande was one of the officers who attended the meeting. What instructions were issued by him in the meeting? Were the officers instructed to take firm action? If that was so, then would any officer have dared to disobey the CM over a legal order? And above all disobey the present CM? It is most unlikely.

The government, till this day, has also not taken any disciplinary action against any officer for not following its legal orders. This suggests that it has not agitated by the intentional lack of compliance of its legal orders. Hence, that such a thing would have happened is most unlikely – almost impossible.

The other possibility is that the officers were instructed to “let things happen”? This instruction seems to be consistent with the conduct of the officers and very much in the interest of the political party in power. It is also consistent with the conduct of the government to the whole issue – officers who supported the ‘mission’ were suitably rewarded with important postings; officers, who stood up for their call of duty, were shifted to insignificant and difficult posts.

The mind of the political leadership can also be established by the manner in which the whole of the Godhra Carnage was handled with the personal indulgence of the CM – the bringing of the dead bodies by road through the busy areas of cities including Ahmedabad is just one example. Other acts of intended to “provoke” would certainly be within the knowledge of the SIT.

2. BILLING PROOFS

Ttough the CD produced by Mr. Rahul Sharma is not a copy of the CDs provided by the cell phone providers, the unzipped data is an exact copy/replica of the data provided by the cell phone providers.

There are possibilities that the data may have been manipulated by Mr. Rahul Sharma. To establish the truth in this regard, the following steps may be taken:
i) Many of the government mobile phones used to receive detailed billing of the cell phone calls. These departments may be found out and bills from those departments may be procured and verified with the cell phone data to confirm its authenticity.
ii) It is also submitted that zipping and unzipping of data is an automatic process beyond the control of human beings. That would not alter the nature of data. Therefore, once the data is unzipped, it would amount to a copy of the data provided by the cell phone providers.
iii) It is also submitted that efforts should be made to locate the office copies of the CDs provided by the mobile phone providers. In any case, if data is provided by a mobile phone company, they should be keeping an office copy of the data provided by them. Else, how would they prove the data sent by them? The inside information is that the cell phone companies have the data but they are “scared” of coming up with it under political/police pressure.
iv) Efforts should also be made to recover the original CDs, which are lying with the Crime Branch of Ahmedabad City. If these CDs are made available, there would not be any need to make Mr. Rahul Sharma a witness.
What should be done to analyze the CD:

1. Collect all communications made between police officials/Ahmedabad City Police Control Room/State Control Room/ Police Stations for the period 27.02.2002 to 04.03.2002.
2. Every police officer of or above the rank of a DCP has with him a wireless operator who writes down all messages pertaining to the officer he is attached with in a book. Collect all such books of all officers of the rank of DCP and above.
3. Collect copies of all station diaries made between the above-mentioned dates.
4. Digitize all the records of communications and other relevant information into an MS Access database.
5. Analyze the data thus collected in the background of the cell phone data and other evidence.
6. The entire procedure can be time consuming and databases have to be constructed carefully.


For all this to happen SIT needs to appoint a high level expert team, inside or outside of itself to perform the task of

a) Analysing CD phone call details with other materials
b) Analyse RB Sreekumar’s four affidavits and investigate therein

Or else the second investigation will be rendered a farce.
